Your Estate Planning Journey with Campbell Law
Thoughtful estate planning, professionally delivered.
Navigating the future of your legacy is a significant step. At Campbell Law, we guide you through a transparent and thoughtful process to ensure your wishes are legally protected and carried out seamlessly.
We begin with a comprehensive and confidential consultation to understand your unique circumstances, family dynamics, financial goals, and specific estate planning needs. Our consultations are completed in person, by phone, or via video conference, accommodating your needs wherever you are.
- Discuss Your Family Situation: We explore your family structure and key relationships.
- Review Your Assets and Goals: We examine your financial affairs, assets, and objectives for your estate.
- Identify Potential Limitations or Challenges: We pinpoint any complexities or legal considerations that may impact your plan, including ensuring you meet the age requirements to make a will (generally 18 years old, with limited exceptions) and possess the necessary testamentary capacity (a "sound disposing mind" understanding the nature of the Will, the extent of your property, and potential claims against your estate) to advise counsel.
Building on your initial consultation, our experienced team develops a customized estate plan that precisely addresses your specific needs and goals.
- Customized Estate Plan Design: We design a plan unique to you, which may include primary and secondary Wills, Powers of Attorney for Personal Care, Continuing Powers of Attorney for Property, and Trusts.
- Transparent Pricing and Timeline for Completion: You'll receive information regarding the costs and the anticipated timeline for completing your estate plan.
- Recommendations Tailored to You: We provide strategic recommendations that align with your circumstances and objectives.
Our legal team drafts all necessary documents for your estate plan. These can include your Will(s), Powers of Attorney for Personal Care, Continuing Powers of Attorney for Property, Marriage Contract, Trust(s), and other required legal instruments.
- Explanation Guide or Letter to Client: We provide guides and/or letters to ensure you understand and confirm that your wishes are accurately reflected in the drafts.
- Drafts Provided with Clarity and Intention: Every document is drafted with precision, ensuring its legal intent is unambiguous and that your testamentary intentions are clearly set out.
- Comprehensive Protection of Your Wishes: Our goal is to create documents that provide robust protection for your legacy and ensure your directives are enforceable.
We arrange a dedicated meeting with you to review all of the drafted documents from our office. During this review, we explain the purpose and implications of each provision in plain language, making any adjustments necessary to reflect your intentions.
- Counsel Review with the Client: We review the documents and make necessary changes or clarifications.
- Client Review of Documents: The Client reviews the documents for correct spellings, references, and confirmation of their wishes off all drafts at their own pace.
- Final Adjustments if Needed: We make any necessary final revisions to ensure the documents accurately represent your exact wishes. Note that any alterations to a will made after its execution generally require re-execution or specific witnessing to be valid.
Once you have given your final approval, we meticulously guide you through the proper signing and witnessing of all documents. This critical step ensures they are legally valid and executed correctly in the SLRA.
- Proper Document Execution per Succession Law Reform Act: We ensure your Will is in writing, signed by you (or by another person in your presence and by your direction) at its end, and that two or more attesting witnesses subscribe to the Will in your presence after you make or acknowledge your signature in their presence at the same time. We emphasize that strict compliance remains vital to prevent challenges. However, the Superior Court of Justice has authority under Section 21.1 to order that a document not properly executed is valid if it sets out the deceased's testamentary intentions.
● Secure Storage Options: We advise on secure storage solutions for your original documents.
● Annual Review Scheduling: We recommend scheduling regular reviews to accommodate changes in your life, assets, or legal landscape, such as marriage (which no longer automatically revokes a will for marriages on or after January 1, 2022) or separation (which can impact spousal entitlements), ensuring your plan remains current and effective.
